Deepin ID Service Agreement

Welcome to register and use the deepin ID provided by deepin Community.

If you are a user outside the mainland China, you shall abide by the laws of the country or region which you belong to or where you reside when entering into or fulfilling this Agreement.

You agree to the terms and use conditions by means of, but not limited to: (1) acceptance by clicking “I Agree” or other means; (2) oral or written representations made through email, telephone, fax, instant messaging, etc.; (3) the tacit consent clauses contained in the agreement and use conditions (including but not limited to service descriptions, usage help, etc.) which you have no objection to; (4) other means we both parties approve.

1.Scope of Application

1.1 The deepin ID Service Agreement ("the Agreement") defines the rights and obligations between you and UnionTech Software Technology Co., Ltd. and its affiliated companies ("UnionTech Software" or "us") regarding your application of registering the “deepin ID” and using it in the related products and services provided by us. To avoid ambiguity, the “affiliates” in this Agreement refers to the entity controlled directly or indirectly by UnionTech Software Technology Co., Ltd. or any company or legal entity under common control with UnionTech Software Technology Co., Ltd., including but not limited to [Wuhan Deepin Technology Co., Ltd.] for the purpose of this Agreement.

1.2 You can login with the “deepin ID” and use the related products and services provided by UnionTech, including but not limited to “deepin User Center”, “deepin App Store” and “deepin Operation System” subject to the service terms of the individual product or service you use. The service terms of each individual service or product have the same legal effect as the Agreement, and you shall observe them at the same time.

1.3 The Agreement includes the following terms and various service rules released or to be released possibly in deepin User Center. All service rules are an integral part of this Agreement and have the same legal effect as the Agreement.

2.About deepin ID

2.1 deepin ID is UnionTech’s identifier for you. The ownership of the deepin ID belongs to UnionTech and you, as the initial register, only has the legal right to use your registered deepin ID.

2.2 You can enjoy each single service provided by UnionTech via the deepin ID, including but not limited to deepin User Center, deepin App Store, deepin Operation System, etc.

2.3 The deepin ID is provided by UnionTech. You shall abide by the Agreement when using the deepin ID.

3.Account Usage Rules

3.1Account Registration

（1）In order to provide you with deepin account services, you need to follow the prompts on the registration page to fill in the corresponding information, read and agree with the Agreement, submit complete and accurate registration information (including but not limited to User Name, Mobile Number, Email Address, Identity Verification Code, Password, etc.) and finish registration.

（2）In order to provide consistent services, we may synchronize your login status in your first use of other products and services provided by UnionTech if you have already logged into a certain product or service in User Center with the deepin ID. No extra personal information will be collected and used in this process.

（3）Only when you fully agree with the Agreement, can you register a deepin ID. If you disagree with the Agreement and/or its modifications at any time, you may voluntarily stop the service provided by us.

（4）In accordance with the provisions of the national laws and regulations, you are obliged to provide your personal information according to our requirements and ensure the authenticity, validity and reliability of the information aforementioned when applying for a deepin ID. We will allocate a registration account (“deepin ID”) for you after passing the verification of UnionTech User Center. In accordance with the provisions of current Chinese laws and regulations and normative documents, and for the performance of related services, you are obliged to ensure the authenticity and validity of the information provided and are also obliged to notify us for timely update in the event of any change in relevant information materials. If you are found to provide any incorrect, false, outdated or incomplete information, or we have reasonable grounds to suspect that the information provided is incorrect, false, outdated or incomplete or the administrative and judicial authorities verify that your information is invalid or the administrative and judicial authorities verify that your information is invalid or we find you are not the initial registrant of the deepin ID, we have the right to terminate or suspend our services, or restrict your use of all or part of the functions provided by us. In addition, we are entitled (but not obliged) to send you an inquiry and require you to make corrections. If you refuse to make corrections or cooperate with us upon our notification, you shall bear all the losses and adverse consequences caused thereby.

（5）Our services are only available for users over 14 years old. You shall understand clearly that we can suspend or terminate our services to you at any time if we find or suspect you are under 14 years old when providing services until you prove to us you have been 18 or assist us in obtaining the express consent of your guardian.

3.2Account Use

（1）You shall be responsible for all the results of actions under your deepin ID (including but not limited to signing various single terms online, publishing information, downloading applications, purchasing goods and services, disclosing information, etc.)

（2）Since your deepin ID is associated with your personal information and UnionTech business information, it is available for your own use only. Your direct or indirect authorization to a third party to use or obtain the information under your account is invalid without consent of UnionTech. If your use of the deepin ID is determined that may endanger your account security and/or UnionTech information security in accordance with the default determination procedures and standards, UnionTech can refuse to provide corresponding services or terminate the Agreement.

（3）The deepin ID includes the user name and password and you can login with the set user name (including mobile number/email address) and password. To ensure the account security in use on different terminals and habits, we may adopt different verification measures to identify your identity, including but not limited to SMS verification codes and service information verification.

3.3Account Preservation and Retrieval

(1) The deepin ID is the basis for us to identify you and provide services for you. The deepin ID includes the account name and password and you can login with the set account name (including the account ID and mobile number) and password. You shall have your account name and password properly preserved, restrict third parties from using/accessing your computer or mobile devices, ensure not to disclose your login password to any third party and modify the password periodically. Please provide the corresponding information according to the deepin ID retrieval procedure and ensure legality, authenticity and validity of the information provided if you need to retrieve the account information. If the information provided does not meet the requirements and fails in UnionTech security verification, we are entitled to refuse the account retrieval service.

(2) If the current deepin ID in use is not initially applied for and registered by you or obtained by other channels provided by UnionTech, but you know the current password, you are not allowed to login and perform any operation with the deepin ID. Please notify UnionTech or the initial registrant of the deepin ID in the first time.

3.4Account Transfer

(1) You may use the deepin ID within the scope of the Agreement and shall not register a deepin ID maliciously, grant, borrow, rent, transfer it with or without compensation, sell it or otherwise allow a non-initial registrant to use it. We have the right to judge and deal with the actions above independently and you shall bear all the responsibilities arising therefrom. Meanwhile UnionTech reserve the right to pursue the legal responsibility of the actor aforementioned. All the responsibilities arising therefrom shall all be borne by you.

(2) UnionTech are entitled to take the following measures against you in accordance with the laws and regulations:

a) In case of your violation of the laws and regulations, each single term or business rule of UnionTech, UnionTech have the right to judge them independently and take the measures at any time such as asking you to take corrections within a time limit, suspending, terminating and resuming your use of the deepin ID according to the actual situation.

b) If you are found to be the non-initial registrant of the deepin ID, UninTech has the right to terminate your use of the account without notice.

c) UnionTech take the measures such as asking you to take corrections within a time limit, suspending or terminating your use of the deepin ID in accordance with the rules or related laws and regulations and the losses caused thereby (including but not limited to communications interruption, emptying of user profile, email, related data, etc.)

3.5Account Reclamation and Cancellation

(1) To avoid resource occupancy, UnionTech have the right to cancel your deepin ID that has not been in use or with which you haven’t logged in through the means that UnionTech acknowledge for 24 consecutive months and you will no longer be able to log in with the account or use related services. If there is any pending transaction or balances associated with the account, UnionTech will assist you handling it within a reasonable range. Please follow the instructions by UnionTech.

(2) You acknowledge and agree that you are only available to apply for canceling your own account and you need to cancel it according to the procedures of UnionTech; You shall still be responsible for you actions before canceling your account and during your use of the services provided by UnionTech. You shall know that the termination of your account means deletion of your user contents from our activity database.

3.6Account Security

(1) Your account is set and kept by yourself and UnionTech will never ask you to provide your account and password at any time. You are suggested to take specific measures to protect your account security, including but not limited to installing anti-virus Trojan software, changing your password regularly, etc.

(2) UnionTech shall not be responsible for the losses and consequences caused by your voluntary disclosure of the deepin ID, attack and fraud by others, etc. You shall recover from the infringer through judicial, administrative relief, etc.

4.Content Specification

4.1 You can publish, in the service or product of your login deepin ID, comments, opinions and replies (including but not limited to web pages, characters, tabs, pictures, audios, videos, charts, electronic documents, etc.) and put forward suggestions, opinions or other information to us on the requisite that the information and content comply with the current Chinese laws, regulations and other normative documents,have legal sources or authorization of related right holders, do not contain anything illegal, obscene, threatening, defamatory, infringing privacy, infringing intellectual property rights or otherwise causing damages and infringement to the rights of a third party, or arousing public resentments, do not contain software virus, political propaganda, business solicitations, chain letters, bulk mail or any form of “spam”. You shall not use false email address and mobile number, impersonate any other person or entity or otherwise mislead others on the source of related contents. In addition, as for the suggestions, opinions and other information aforementioned, unless you raise a written request in advance, you agree to grant us the following license of non-exclusive, free, permanent, irrevocable and complete sub-license: using, reprinting, modifying, recompiling, publishing, translating and creating derivative works and distributing and displaying these contents on any media worldwide. Meanwhile, (1) No matter whether you have any objection to the aforementioned rights we enjoy, we have the right to use all or part of the contents aforementioned for publicity and promotion purposes. You agree not to claim any form of breach of contract, infringement or other claims against us for the use aforementioned. (2) If any third party violates the aforementioned contents, materials or names, you hereby authorize us to bring a lawsuit to the infringer as the rights holder of the relevant contents, and promise to give us all necessary authorization allowed by the current laws and regulations so that we can enjoy the proper litigation subject status.

4.2 Meanwhile the content transmitted and published in or through the service and product under your deepin ID does not reflect or represent and shall not be deemed to reflect or represent our opinions, positions or policies. You shall make your own judgment on the related content yourself and bear all the risks and losses arising from trusting in and using such content. We shall not assume any responsibility for this. We reserve the right (rather than obligation) to review, remove or edit such content. Unless otherwise provided by law, we will not conduct any prior one-to-one inspection, monitoring, examination, approval or other regular review of the content you post. If you find other users upload false, illegal contents, etc., please contact us or report to us in time and provide related supporting documents. We will provide assistance and deal with it in a timely manner according to your reasonable request. You hereby declare and guarantee to compensate us for any damages arising from your content on the service platform or other space we provide.

5.Code of Conduct

You shall not implement personally or assist or allow others to implement the following acts in your use of the service and product provided by UnionTech under your deepin ID:

5.1 Uploading, displaying, posting, disseminating or otherwise transmitting the information containing any of the following:

(1) Objecting the basic principles established in the Constitution;

(2) Endangering the national security, leaking the state secrets, subverting state power or undermining the national unity;

(3) Damaging the national honor and interests;

(4) Inciting ethnic hatred, ethnic discrimination and undermining national unity;

(5) Disrupting national religious policies or promoting cults and feudal superstitions;

(6) Disseminating rumors, disrupting the social order or undermining the social stability;

(7) Spreading obscenity and pornography, promoting gambling, violence, homicide and terror or instigating crime;

(8) Insulting or slandering others or infringing the legal rights and interests of others;

(9) Containing false, harmful, coercive, privacy-infringing, harassing, infringing, slanderous, vulgar, obscene, or other morally repugnant content;

(10) Containing other contents restricted or prohibited by the Chinese laws, regulations, rules, ordinance and any legally effective normative documents.

5.2 Engaging in the following activities by using of the products and services provided by UnionTech:

(1) Accessing the computer information network or using the computer information network resources without authorization;

(2) Deleting, modifying or adding computer information network functions without authorization;

(3) Deleting, modifying or adding the data and applications stored, processed or transmitted in the computer information network without authorization;

(4) Making and spreading computer viruses and other destructive programs intentionally;

(5) Carrying out any commercial activities such as publishing advertisements and selling commodities or other illegal activities that infringe the interests of UnionTech;

(6) Carrying out other actions endangering the computer information network security.

5.3 Engaging in illegal transactions, such as money laundering and drug trafficking.

5.4 Committing infringements of other people’s privacy rights, copyrights, patent rights, trademark rights, and other rights and interests, unless you have obtained the full and effective authorization of the right holder in advance;

5.5 Conduct violations of the laws and regulations, policies, rules and regulations, as well as related agreements and rules of the services and products provided by UnionTech;

5.6 Collecting other user’s information without authorization;

5.7 Publishing advertisements in any form without authorization;

5.8 Interfering with the normal operation of the services and products provided by UnionTech with any kinds of technologies and means and causing adverse effects on the services and products provided by UnionTech;

5.9 Modifying, tampering with, blocking or partially blocking the services and products provided by UnionTech and their related features (including banner ads, etc.);

5.10 Misappropriating with any technical means the contents and characters in the services and products provided by UnionTech;

5.11 Uploading and publishing any internal material, confidential material or other contents, information and/or remarks without authorization;

5.12 Without our prior written consent, using, renting, lending, copying, modifying, linking, reprinting, compiling, publishing and releasing the services and products provided by UnionTech and related information and/or establishing mirror sites and using the services and products provided by UnionTech to develop derivative products, works, services, plugins, add-ons, compatibility, interconnection, etc. in connection with them without authorization;

5.13 Reverse engineering any software or program provided by UnionTech, such as disassembling, decompiling, etc.;

5.14 Modifying or falsifying the instructions, data, and data packages of the software works in operation by UnionTech, adding, deleting, or changing the functions or operating effects of the software to transmit and operate the software used for the aforementioned purposes to the public through the information network;

5.15 Logging into or using the products and services provided by UnionTech through third-party compatible software and systems that are not developed, authorized or approved by us, and/or use plug-ins and add-ons that are not developed, authorized, or certified by us for the products and services provided by UnionTech;

5.16 Using the products and the services provided by UnionTech in any illegal way, for any illegal purpose, or in any way inconsistent with this Agreement; or conducting activities that violate the laws and regulations, infringe the legitimate rights and interests of other users and interfere with the normal operation of the products and services provided by UnionTech or actions that are not expressly authorized by us.

6.User Information Protection and Authorization

User information protection. It has been our basic policy to respect the privacy of users and we will collect, store,use, disclose and protect your personal information in accordance with deepin Operation System Privacy Policy as well as the Privacy Guidelines of each specific product. Please read fully and carefully to assist you in better protection of your personal information. 7.Intellectual Property Rights Specification

7.1 Intellectual Property Rights Guarantee

You shall ensure that you have full rights or authorization to the characters, pictures, etc. you publish on the products and services provided by UnionTech and you hereby promise that such characters, pictures, etc. will not infringe the legitimate rights and interests of any third party, including but not limited to copyrights, portrait rights, privacy rights, trademark rights and other personal and property rights. For any losses to UnionTech, other users of UnionTech or other third parties arising from your violation of the intellectual property rights guarantee in this Agreement, you shall assume corresponding compensation liabilities.

7.2 UnionTech Intellectual Property Rights and Related Rights Reservation

Without the prior written consent of UnionTech, you have no right to use any of the intellectual property rights of UnionTech. You shall guarantee, state and promise that you respect the intellectual property rights of UnionTech and will not personally or urge a third party, nor will you allow or indulge any third party to apply for trademarks, domain names, wireless websites, internet search terms or any trade names and service marks similar to UnionTech or its affiliates in any jurisdiction for any marketing, advertising, promotion or other purposes. In the event of the situations above, you must transfer all the related rights to UnionTech at your own expense. You guarantee, states and promise that you will not use the following names (including but not limited to “UnionTech”, “UnionTech UOS”, “UnionTech Operation System”, “deepin”, “deepin Operation System”) and the affiliated logos and designs of the brands above as a part of the enterprise, merchant, service or product name, nor will you use the intellectual property rights of UnionTech trademarks or similar trademarks. All the losses caused to UnionTech due to your violation of the term shall be borne by you.

7.3 Infringement Complaint

(1) [Intellectual Property Rights Infringement] We respect the intellectual property rights of others. If your legitimate rights to related characters, pictures, etc. are infringed by a third party in UnionTech or a third party believes that you have committed infringement on their legitimate intellectual property rights to characters, pictures, etc. in the product and service provided by UnionTech, any party has the right to issue a written notification to UnionTech in accordance with the Infringement Complaint Rules published by UnionTech. UnionTech will deal with such characters, pictures, etc. suspected of infringing the intellectual property rights. In the meantime, you agree to compensate us for any third-party claims against us that may arise from the notification you submit, including but not limited to all the reasonable expenses incurred by us.

(2) [Other Rights Infringement] If a third party believes that you have committed infringement on other rights of the legitimate rights other than the intellectual property rights for your characters, pictures, etc. published on the products and services provided by UnionTech and UnionTech have preliminarily verified the suspicion of infringement but you fail to provide evidence to the contrary, UnionTech have the right to delete the characters and pictures, etc. suspected of infringement on other rights from the products and services provided by UninTech. Please refer to the Infringement Complaint Rules for details.

8.Disclaimer

8.1 Even though we strive to provide you with quality services and experiences, please understand that we or the third party we cooperate with cannot guarantee the following:

(1) The products and services we provide meet your specific needs;

(2) We will provide you with accurate, safe, lasting, reliable and defect-free services without interruption;

(3) There is no information storage failure, communication failure, technological issue, network failure, system instability, hacker attack, virus intrusion, illegal content, government control, etc. in deepin User Center;

(4) Any of your information will never be lost, deleted, damaged or leaked at any time;

(5) All the products and services in deepin User Center meet the expectations of users.

9.Advertisement

9.1 The services we provide may contain advertisements andyou agree to display the advertisements and third party links provided by us, third party suppliers and partners during use. Unless otherwise expressly provided by the laws and regulations, you shall be solely responsible for the transactions based on the advertisement information and we bear no liability for any of your losses or damages arising from the transactions based on the advertisement information or content provided by the advertisers aforementioned.

10.Force Majeure

10.1 Under no circumstances shall we be liable for failure or delay in fulfillment of the Agreement due to normal maintenance of the Internet equipment, failure of Internet connection, failure of computer communication or other systems, power failure, strikes, riots, turbulence, catastrophic weather (such as fire disaster, flood, storm, etc.), explosions, wars, government actions, and orders of judicial and administrative organs.

11.Liabilities for Breach of Contract and Compensation

11.1 [Infringement Treatment] Please respect the ownership and intellectual property rights of us and any third party. If we have reasonable grounds to prove that you have committed infringement, we have the right to claim your infringement liability. Meanwhile, you shall compensate us in full for the losses suffered due to your infringement including but not limited to arbitration fees, litigation fees, attorney fees, travel expenses as well as all the reasonable expenses incurred by us.

11.2 [Complaint Treatment] If you are reported or complained by other users or we have reasonable grounds to find that you are suspected of violating the related laws and regulations, Agreement, deepin Operation System Privacy Policy or other service rules, we have the right to review the relevant content (including but not limited to reviewing all user information and materials, chatting history, etc.), delete, block, and implement penalties to the violation account including, but not limited to, warnings, restrictions or prohibitions on the use of some or all functions, account bans until cancellation according to the actions and circumstances at any time without notice, announce the results in accordance with the laws and regulations and inform the public security organs and other departments when necessary.

11.3 [Penalties] You understand and agree that we are entitled to implement penalties to actions against the relevant laws and regulations or the Agreement based on reasonable judgment, adopt appropriate legal measures against any users who violate the laws and regulations, keep the relevant information to report to relevant authorities in accordance with the laws and regulations, etc. You shall bear all the liabilities arising therefrom solely.

11.4 [Compensation Liability] You shall be fully liable for the claims, losses, damages, liabilities, costs, expenses (including but not limited to attorney expenses), etc. incurred to us or the third party due to your breach of contract, infringement or illegal actions committed. In the event of your violation of the laws and regulations as well as the Agreement, we have the right to freeze and/or deduct all or part of the expenses that shall be paid to you as penalty and reserve the right to recover it from you if such penalty is insufficient to compensate our losses suffered thereof.

11.5 [Third Party Damage] For the property or personal losses or damages caused by the third party, please inform us immediately and we will provide assistance to contact the third party for communication and negotiation. During this process, please give us reasonable preparation and contact time.

11.6 [Cap on Liability] To the maximum extent permitted by the laws and regulations, we are only liable for the services in this Agreement and our compensation liabilities shall be limited to one (1) times of the service charges for the specific service we provide. In addition, we and our affiliates are independently responsible.

11.7 [Indirect Loss] Unless otherwise stipulated by law, our compensation for you is only limited to direct losses, excluding indirect losses, accidental losses, special losses, consequential losses, punitive losses, incidental losses, goodwill losses, profit losses, etc.

12.Agreement Termination

12.1 In the event of Article 12.2 in this Agreement and other circumstances that shall terminate the service, we can notify you to terminate this Agreement in the manner listed in Article 13 or have the right to cancel your account to terminate this Agreement under the condition that you have not logged in your account for a long time in accordance with the Agreement.

12.2 You have the right to terminate this Agreement by canceling the account. Only when the following conditions are met, can you apply for canceling your account:

(1) The account is in normal use. There is no record of restricted account, established report or complaint.

(2) The account is secure. You haven’t carried out sensitive operations such as password change and bind change and your account is not at the risk of being stolen or blocked.

(3) There is no ongoing transactions and the last order (if any) is finished over 15 days ago.

12.3 It is important to note that account cancellation is unrecoverable. After successful cancellation, your account information, transactions and service records, etc. will not be retrieved or restored.

12.4 After the termination of this Agreement, you shall still bear corresponding responsibilities for the use of deepin ID and specific products and services before the termination of this Agreement.

13.Notification

13.1 When you register a deepin ID and accept a specific product or service, you shall provide us with authentic and valid contact information (including your phone number, email address, contact address, etc.). In the event of any change in contact information, you are obliged to update the related information and make sure that you can be contacted.

13.2 We will contact you by telephone, SMS, email, and by posting announcements, notifications, or statements on specific product websites and clients, and WeChat public accounts. You agree to the notifications we send to you by the contact method aforementioned, in which the written notification sent electronically will be deemed to be delivered after being sent successfully and the written notification sent by the paper carrier will be deemed to be delivered on the fifth natural day after being mailed according to the contact address submitted.

14.Applicable Laws and Dispute Settlement

14.1 You agree that any disputes between you and us related to this Agreement shall be governed by the laws of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan), excluding the applicable conflict rules.

14.2 We have the right to modify the Agreement at any time in accordance with the changes of related laws and regulations and the operation status and strategy adjustments, publish the modification notifications of these terms on each product webpage and/or client of UnionTech and list the latest modification date. In the event of any dispute, the latest version of Agreement shall prevail. If you do not agree to the changes we made to the corresponding terms, you have the right to stop using the services we provide. If you continue to use the service provided in UnionTech, you are deemed to have accepted the modifications of related terms in this Agreement by us.

14.3 If any term in this Agreement is deemed to be annulled, invalid or unenforceable for any reason, this term shall be deemed to be divisible and shall not affect the validity and enforceability of any remaining term of this Agreement.

14.4 Any dispute arising from or in connection with this Agreement shall be settled through friendly negotiation between you and us. If the negotiation fails, any party can bring a lawsuit to the People’s Court located at [Daxing District, Beijing].
